The Yuill & Kyle Court Action
If your customer does not respond to our letter before court action you may wish to institute legal proceedings. In our experience recovery rates are particularly good if a debtor is still trading. Our strong advice is the quicker you initiate action the better your chances are of being paid. If you are particularly concerned about a debtor you are able to instruct a FREE Yuill & Kyle search as well as using our pre-judgement remedies. We are happy to enter into financial arrangements on your behalf and monitor payments. If your customer simply ignores the court action we will be able to enforce the judgement by using the post-judgement remedies.
What do we do?
Institute court action anywhere in Scotland as soon as we receive your written instructions (instructions can, of course, be faxed)
Send a further letter to the debtor once court action has been initiated.
Serve Summons (by Sheriff Officer if necessary)
Obtain Decree (judgement)
Pre-Decree remedies (inhibitions/arrestment)
Post-Decree remedies by enforcing judgements using established Sheriff Officers
Remind you when the Debtor seven days are up to see if you wish to take any further action.

Our costs are detailed above in "a" together with the fixed costs (judicial expenses) and any disbursements such as Sheriff Officers fees.

Additional costs
For each stage of enforcement (diligence) there is an administrative fee of £10.00.

We do ask that our accounts are settled no later than 28 days after the date of the invoice.
