Whilst many clients find our pre-sue service does the trick and no further action is needed, some still need to take court action to get paid. Experience has taught us that the quicker you start legal proceedings, the better chance you have of recovering the money owed. It is likely that your debtor will also have other creditors looking for payment too, which means it is in your interests to act quickly.

However, there is no point in pursuing someone who cannot pay you. Nobody wants a judge rule in their favour only to find out the debtor cannot meet their financial obligations. For your added peace of mind, we have tools in place to help you avoid this expensive mistake. Our extensive database helps us understand the debtor’s current financial status and ability to pay – preventing you from wasting your time and money on court proceedings.

What do we do?

We move into action as soon as we receive your instructions (whether online, by letter, fax or email) and we can issue proceedings anywhere in Scotland. To ensure you get paid as soon as possible, we draft all documentation and send it to court within 48 hours. Once the court processes the papers (usually within 7-14 days) we then serve them on your debtor. If your debtor ignores the court action, we will enforce the judgment using our post-judgment remedies.
